TERMS AND CONDITIONS OF SALE –
DI SARNO CAR SERVICE S.R.L.
1. Subject and Acceptance of Terms
The booking of one or more services offered by Di Sarno Car Service S.R.L. through the official website, online booking platforms (OTAs), or booking engines (e.g., Bokun) implies the full and unreserved acceptance of these Terms and Conditions of Sale. Acceptance of these Terms is an essential and binding condition for the provision of services.
2. Nature of Services
The services offered include: Chauffeur Driven Services (NCC), private or group sightseeing tours, day trips, and shore excursions. Unless otherwise stated in writing, the Company operates exclusively as a Chauffeur Service provider. Any services provided by third parties (e.g., tour guides, ferries, entrance tickets to archaeological sites, restaurants) are provided by independent operators over whom the Company exercises no direct control or management responsibility.
3. Bookings and Confirmation
A booking is considered confirmed and binding only following:
Full or partial payment of the amount, where required.
Receipt of written confirmation via email or booking platform. The client is responsible for the accuracy of the data provided, including date, time, number of passengers, contact details, and pick-up location.
4. Prices and Inclusions
Prices are expressed per person or per service, as specified. They include only what is indicated in the “Included” section. They do not include entrance fees, meals, gratuities, or optional services unless expressly stated. Obvious pricing errors due to technical or IT malfunctions are not binding and may result in the cancellation of the booking.
5. Payments and Security
Online transactions are managed via encrypted security protocols (SSL) provided by the respective payment gateways (e.g., PayPal, Stripe). Failure to pay within the indicated terms will result in the automatic cancellation of the booking without any obligation or liability on the part of the Company.
6. Cancellation Policy
Unless otherwise communicated at the time of booking:
Cancellations more than 24 hours before the service: Free of charge.
Cancellations within 24 hours of the service: Penalty of up to 100% of the total cost.
No-show or failure to arrive: 100% of the service fee will be charged.
7. Delays and Waiting Time
Standard Pick-ups: In the event of a delay exceeding 15 minutes from the agreed time, the service will be considered a "No-Show" and is non-refundable.
Airport Pick-ups: For arrivals at airports, the tolerance is extended to 60 minutes from the actual flight landing time. Beyond this limit, if the client has not contacted the driver or the office, the driver is authorized to leave the position, and the service will be charged in full.
8. Modifications and Force Majeure
The Company reserves the right to modify itineraries, schedules, or stops due to traffic, safety, weather conditions, extraordinary events, or force majeure. Such changes do not constitute a breach of contract.
9. Services Subject to External Factors
Certain activities (e.g., Blue Grotto, ferry transfers, archaeological sites) depend on sea/weather conditions or decisions by local authorities. The inability to access these services does not automatically entitle the client to a refund for the NCC transport service.
10. Limitation of Liability
The Company’s liability is strictly limited to the performance of the purchased NCC service and shall in no case exceed the amount paid for said service. The Company is not responsible for disruptions or cancellations attributable to third-party providers.
11. Complaints
Any complaints must be submitted in writing within 7 days of the service date. Complaints received after this deadline will not be considered.
12. Applicable Law and Jurisdiction
These Terms are governed by Italian law. The exclusive jurisdiction for any dispute shall be the Court of Naples, Italy.
